On Saturday, July 10, 2010, Officers of the Estherville Police Department investigating illegal drug activity, obtained a search warrant for an Estherville residence .
At 0138 hours on that same date, the warrant was executed at 4 North 7th Street, Gardston Apartments #210. At the completion of the search, a total of more than 14 ounces of marijuana, $2,500 cash, and drug paraphernalia was seized as evidence. Officers arrested Tyrell Douglas Howard, age 23 of Estherville at the scene of the search. Howard was charged with one count of Possession of a controlled substance, marijuana, with intent to deliver, and one count of Tax Stamp Violations, both Class "D" felonies. Howard was additionally charged with possession of drug paraphernalia, a simple misdemeanor.

After appearing in magistrates court on his initial appearance, Howard was returned to the Emmet County Jail pending the posting of $15,000 cash or surety bond.

Don’t Get “Popped” for Drunk Driving This July 4th
In conjunction with the Fourth of July holiday period, Iowa law enforcement agencies are announcing they will again be out in full force starting July 2nd through the 5th, cracking down on impaired drivers and other traffic violators to prevent crashes and save lives.
With hopes of warmer weather and an extended weekend, law enforcement will gear up for the 4th of July weekend. In addition to speed and seat belt violators, they will target drunk drivers. “Driving while drunk isn’t worth the tremendous risk,” said Larry Sauer, Bureau Chief at the Iowa Governor’s Traffic Safety Bureau. “No matter your age, if you’ve had too much holiday spirit, you’d better find a safe and sober ride home or your chances of arrest are high.”
Sauer cited recent statistics to underscore the importance of the crackdown. “According to the National Highway Traffic Safety Administration during the 2008 July 4th holiday period (6:00 p.m. Thursday July 3rd to 5:59 a.m. Monday July 7th) our nation recorded a total of 491 traffic-related deaths.”
Although Iowa had only 2 traffic fatalities in 2009, our 10-year average for this holiday period is 5. “Too many people still fail to understand that not buckling up, not driving the speed limit and driving impaired leads to loss of lives. It’s vitally important that we bring this tragic situation to an end,” said Sauer. “The cost of not obeying these and other traffic laws could be your life or the life of a loved one.”
During the 2009 July sTEP wave (special Traffic Enforcement Program), 237 agencies had contact with 472 alcohol/drug impaired drivers, 1,465 seat belt violators and 6,435 speed violators. In all, more than 16,200 traffic violations were recorded. Beyond these violations, officers assisted 844 motorists, investigated 344 traffic crashes and apprehended 143 wanted persons.

2010 CLICK IT OR TICKET CAMPAIGN
“BUCKLING DOWN ON THOSE WHO DON’T BUCKLE UP”
The Estherville Police Department and the Emmet County Sheriff’s Department will join other agencies across the country to participate in the National “Click It or Ticket” campaign. Officers will be out in force beginning May 24th and through June 4th enforcing traffic laws and making sure you are buckled up and driving sober. During Memorial Day weekend last year 12 fatalities occurred on Iowa roadways.
Randy Hunefeld, sTEP Coordinator with the Governor’s Traffic Safety Bureau advises that, “Iowa’s law enforcement community is serious about saving lives.” Iowa currently has a 93% statewide seat belt daytime average which ranks in the top 10 in the nation, however our night-time seat belt average is only 39%. This year we are asking our law enforcement partners to continue their efforts in daytime enforcement but to take the fight to the night. Fifty percent of our fatalities occur in the daytime with 88% of the motoring public, while the other 50% occurs during the nighttime hours with only 12% of the motoring public.
During 2009, Iowa had 372 fatalities, in which 172 occurred between 6:00 p.m. and 5:59 a..m. Added enforcement efforts around the State like nighttime seat belt projects, safety checkpoints and added patrols appears to have been effective. Iowa law enforcement is committed to saving lives and they will enforce our seat belt law to do it.
Last year during the “Click it or Ticket” campaign, there were 245 agencies and 1,823 officers that participated recording 43,906 traffic violations ranging from operating while intoxicated to minor equipment violations and everything in between. Officers investigated 1,492 crashes and reported 2,064 motorist assists.
“Local motorists should be prepared for stepped up Click It or Ticket activities that will take place around the clock. If law enforcement finds you on the road unbuckled anytime or anywhere, you could receive a $93.75 ticket. If you buckle up, you’ll save the cost of a ticket and may even save a life.

ESTHERVILLE POLICE INVESTIGATE FELONY ASSAULT
Estherville, IA – On Saturday, May 15, 2010, at 2 a.m., the Estherville Police Department was dispatched to a medical call in the 500 Block of 1st Avenue South in the municipal parking lot. Upon the officers’ arrival, it was determined that an assault had taken place and that two victims were in need of medical attention. Both subjects were transported by Estherville Ambulance Service to Avera Holy Family Hospital for treatment of head injuries.
During the investigation of the assault, officers spoke with several witnesses on scene and were able to identify a suspect in the assault.
The suspect David A. Bennington, age 30, was placed under arrest later on May 15th for 1 – Count of Willful Injury, a Class D Felony and 1 – Count of Serious Assault, a Serious Misdemeanor, and placed in the Emmet County Jail. Bennington was seen by an Associate District Court Judge and held on a bond of $6,350 dollars with 10 percent cash and 90 percent signature bond. As of May 17, 2010, Bennington remainedin the Emmet County Jail on bond.
The Estherville Police Department was assisted at the scene by the Emmet County Sheriff’s Department.

ESTHERVILLE POLICE CONCLUDE DRUG INVESTIGATION
On Monday, April 12th, the Estherville Police Department concluded an investigation into the illegal use and possession of drugs. The investigation began on March 25th, 2010 with the execution of a search warrant at a residence in the 1300 Block of 3rd Avenue North in Estherville. Officers located numerous items of drug paraphernalia and a quantity of marijuana within the residence. During the search, it was also determined that there was a small child living in the house with the suspects.
On Monday, April 12th, officers arrested Sean Anthony Ingvall age 19 of Estherville on an arrest warrant for Neglect of a Dependent Person. Ingvall had previously been charged in the incident with Possession of Marijuana and Possession of Drug Paraphernalia. Erica Lee Book age 19 also of Estherville was arrested on warrants for Neglect of a Dependent Person, Possession of Marijuana, and Possession of Drug Paraphernalia. Invall remains in the Emmet County Jail with a bond of $13,000 cash or surety. Erika Lee Book also remains in the Emmet County Jail on a bond of $14950 cash or surety.
Neglect of a Dependent Person is a Class C Felony punishable by a prison sentence not to exceed 10 years and a fine of at least $675 dollars but not to exceed $6,750 dollars. Possession of Marijuana is a Serious Misdemeanor and Possession of Drug Paraphernalia is a Simple Misdemeanor.
The Estherville Police Department was assisted at the scene by K-9 Max and later assisted by the Iowa Department of Human Services.

Two Iowa Lakes players arrested on drug charges
Two Iowa Lakes Community College Men's Basketball players were arrested on drug charges following an investigation by the Estherville Police Department March 30 and 31.
Estherville Police Chief Eric Milburn said Darryl Davis, Jr., 20, of 300 South 18th Street in Estherville, was arrested after a search on Tuesday turned up 7 ounces of marijuana wrapped in 63 individual packages. Davis was charged with possession of a controlled substance with intent to deliver, failure to possess a drug tax stamp and possession of drug paraphernalia.
In the early morning hours of Wednesday, March 31, a second search was conducted of a vehicle that led to the seizure of 3 1/2 ounces of marijuana. Police arrested Armon Boston, 19, of Milwaukee, Wis. and charged him with possession of a controlled substance with intent to deliver and failure to possess a drug tax stamp.
Both men appeared before the Emmet County Magistrate and were held in lieu of a cash bond of $19,500.
Possession of a controlled substance with intent do deliver marijuana and failure to possess the drug tax stamps are Class D felonies. Possession of drug paraphernalia is a simple misdemeanor.

ESTHERVILLE POLICE AND EMMET COUNTY SHERIFF'S DEPARTMENT JOIN FORCES TO BRING WANTED FUGITIVE TO FACE CHARGES
Estherville, IA – The Estherville Police Department has concluded an investigation into several vehicle burglaries and an intentionally set fire that were reported in the months of March through May of 2009.
During those months, the police department was called to investigate numerous vehicle break ins as well as a fire that occurred in the alley directly behind Racine’s Clothing Store that was determined to be intentionally started. On May 5th 2009, the police department filed charges on two suspects in the crimes.
Michael Mireles age 19 of Estherville was arrested on May 4th 2009 and charged with 4 Counts of Burglary to a Motor Vehicle and 1 Count of Identity Theft as a result of the investigation. Mireles was placed in the Emmet County Jail and was later released pending trial.

Manuel Cantu
The police department also filed charges on Manuel Cantu age 21 of Estherville for his participation in the crimes. Arrest warrants were issued for Cantu’s arrest for 10 Counts of Burglary of a Motor Vehicle, 1 Count of Identity Theft, and 1 Count of 2nd Degree Arson the total bond placed on the arrest warrants is $84,500.
Cantu absconded from Estherville in 2009 and was recently arrested by the New Orleans, La. Police Department. Cantu waived extradition to Iowa and was transported to the Emmet County Jail by the Emmet County Sheriff’s Deputies from New Orleans. Cantu remains in the Emmet County Jail with a bond of $84,500.
All charges of Burglary of a Motor Vehicle and the Identity Theft Charges are Aggravated Misdemeanors punishable by imprisonment not to exceed 2 years and a fine of at least $625 but not to exceed $6,250 on each count. 2nd Degree Arson is a Class C Felony punishable by a prison sentence not to exceed 10 years and a fine of at least $1,000 but not more that $10,000.
All suspects are presumed innocent until proven guilty in a court of law.
Captain Brent Shatto would like to commend the officers for their time and effort put forth investigating these crimes. “I would also like to thank Emmet County Sheriff Mike Martens and his officers for their work in bringing Cantu to Emmet County to face his charges.”

ESTHERVILLE POLICE DEPARTMENT TO HOST CITIZENS ACADEMY
The Estherville Police Department will host another Citizens Academy April 1st 2010, through May 20th 2010. The class will meet once a week on Thursday evenings from 6:30P.M. to 9:30P.M. Students of the academy will be instructed on several aspects of law enforcement including: investigations, SWAT, operating while intoxicated, patrol operations, and firearms just to name a few.
The police department has been conducting citizen’s academies since 2000, instructing over 60 men and women of the community and students at Estherville Lincoln Central High School. The academies were started in 2000 by Retired Officer Terry Watters and will be led by Officers Lewis and Dunlavy. Officer Lewis, himself, is a graduate of the Youth Academy.
The requirements to attend the course will be, that the applicant be 16 years of age or older, no felony or domestic violence charges or convictions pending and have a good standing with law enforcement. It will be open to all people who live and work in the Estherville area. There is no cost to attend the academy. Academy graduates will receive a Citizen’s Academy t-shirt.
There are three ways to obtain an application for the Citizens Academy:
Pick-up an application at the police department, download an application from the department's website or fill-out the application online at the department website. Applications must be returned or submitted no later than Friday March 26th 2010.
We would like to invite anyone interested in a career in law enforcement or anyone that just wants to learn more about the job our officers do, to attend this class.
