ESTHERVILLE POLICE MAKE DRUG ARREST
Estherville, Iowa – On Saturday May 21st, 2011 at approximately 1: 40 A. M., Estherville police officers stopped a motor vehicle for a traffic violation. While speaking with the driver of the vehicle, officers detected that the driver had been drinking. Following an investigation, officers took the driver into custody for an .02 Violation of the Iowa Drinking and Driving Law.

Officers took 20 year old Austin Lindsay of Whitman, Massachusetts, into custody for the impaired driving violation and he was transported to the law enforcement center to submit to a breath test. Officers also impounded Lindsay’s vehicle. During an inventory of the property in Linday’s vehicle, officers found two bags of pills. The pills were determined to be prescription drugs possessed by Lindsay illegally.
Lindsay was booked into the Emmet County Jail for Possession of a Controlled Substance, (Steroid), and Unlawful Possession of a Prescription Drug, (Adderall). Both crimes are serious misdemeanors. Lindsay was released later on Saturday on his own recognizance. Lindsay is innocent until proven guilty in a court of law.
An .02 Liquor Violation, applies to persons under the age of 21, and states that a person under the age of 21 can not have a blood alcohol level above .02 and operate a motor vehicle. The penalty for an .02 Violation is a suspension of driving privileges.
Captain Brent Shatto would like to remind everyone that possession of another persons’ prescription medication is illegal. All medications should be carried in the original pharmacy container or have some documentation that the medication belongs to you. Estherville Police and Emmet County Sheriff’s Department to Participate in Traffic Safety Initiative
Estherville, Iowa – Beginning today May 23rd through June 5th, 2011, the Estherville Police Department and the Emmet County Sheriff’s Department will participate in a traffic safety initiative to promote safe driving habits during the Memorial Day holiday weekend period. The departments will join law enforcement agencies across the nation in the 2011 National Click It or Ticket safety belt enforcement mobilization. During the mobilization, officers will be cracking down on motorists who fail to wear their safety belts – both day and night, as well as all other traffic infractions.
Because nighttime passenger vehicle occupants are among those least likely to buckle up and most likely to die in crashes when unrestrained, nighttime enforcement has become a priority of the Click It or Ticket mobilization. In Iowa, of those who died in nighttime crashes in 2010, nearly two-thirds, or 62%, were not wearing safety belts at the time of their fatal crashes. Additionally, 50% of Iowa’s traffic fatalities occur during the daytime when 88% of the motoring public is traveling. The remaining 50% occur at night when only 12% of motorists are on the road.
Iowa law enforcement will be out en masse during the Click it or Ticket mobilization looking for violators. If an officer finds you on the road unbuckled anytime or anywhere, you can expect to get a $127 ticket — not a warning. No excuses and no exceptions. High-visibility enforcement like the Click It or Ticket mobilization is credited with increasing Iowa’s belt usage rate from 75% in 1997 to an observed daytime usage rate of 93% in 2010. Belt use saves thousands of lives each year across America. According to the Iowa Department of Transportation’s Life Toll program 6,458 lives have been saved wearing seat belts since the Iowa’s safety belt law took effect in July, 1986.
Also, as a reminder, May is Motorcycle Safety Awareness month and with the onset of nice weather, there is an increase in motorcycles on our roadways. Please be aware of their presence during this month and throughout the year.

Estherville Police Assist Estherville Lincoln Central High School with Search for Illegal Drugs
Estherville, IA – On Monday, May 9th, the Estherville Police Department was asked by the administrators of Estherville Lincoln Central High School to assist with a search of the student lockers by utilizing the police K-9.
At approximately 2:00 p.m., Estherville police officers and Estherville police K-9 officer, Max, arrived at the high school building to conduct a search using Max to assist with the detection of any illegal drugs that may be stored in student lockers. At that time, school administrators asked that all students be kept in their classrooms and not be allowed in the hallways, until the planned search was concluded.
The K-9 is led along the front of all lockers in the building. In the event that Max indicates that there are illegal drugs detected in a locker, Officer Reineke reports the information to the school administrators who would have the option to conduct a search of the inside of the locker.

All of the student lockers and the lockers in the locker room were searched. There were no indications by Max that there were illegal drugs being stored in any locker at the conclusion of the search.

This is a follow-up to the Estherville Police Department news release dated 12-07-10 available at http://esthervillepd.net/2010archive.doc.
A Carroll man (formerly of Estherville) involved with distribution of methamphetamine for more than two years will spend at least 13 years in Federal Prison.
Beau Berge, age 29, received the prison term after pleading guilty to the charge in November, 2010. Berge admitted that he conspired to distribute more than 500 grams of methamphetamine from 2008 through February 2010 in the Kossuth and Emmet County areas.

Berge was sentenced in Sioux City, Wednesday by United States District Court Judge Mark Bennett. In addition, Berge will be required to serve a five year term of supervised release after his 165 month prison term is completed (there is no parole in the federal system). Berge is currently being held by the United States Marshals Service awaiting transport to a federal prison.
The case was investigated by the Estherville Police Department, Iowa Division of Narcotics Enforcement, Emmet County Sheriff, Kossuth County Sheriff and Clay County Sheriff.

ESTHERVILLE POLICE INVESTIGATE SEXUAL ASSAULT
Estherville, IA – On Sunday April 10th, 2011 the Estherville Police Department began an investigation in regards to a sexual assault that occurred on Saturday April 9th in the home of an Estherville man. The juvenile victim and her mother reported to police that the victim had received a ride to Estherville from St. James, Minnesota from the suspect.
The suspect took the victim and her friend to his residence where the alleged assault occurred.
The investigation revealed that the juvenile victim and the suspect had been conversing on the internet for some time, and eventually made arrangements for the suspect to go get the victim and her friend.

Following the investigation, Estherville Police took Jesse McIntyre, age 20 of Estherville into custody for Sexual Abuse in the 3rd Degree a Class C Felony. McIntyre was placed in the Emmet County Jail on Sunday, April 10th, and was released on Monday, April 11th after posting a bond of $13,000 cash or surety.

ESTHERVILLE POLICE ARREST TWO IN RASH OF BURGLARIES
Estherville, Iowa – The Estherville Police Department began taking reports of burglaries of garages and cars at numerous locations throughout the city on Thursday April 8th through Sunday, April 10th. The victims reported thefts of fishing poles, car stereos, small electronic devices, and small amounts of money.
During the investigation, officers spoke with two witnesses that had not only observed a suspect in their vehicles on Saturday April 9th, but they also were able to capture and identify the suspect. The witnesses later reported to police the name of the suspect and provided a photo of the suspect involved in their motor vehicle burglaries.
The investigation continued as the suspect was located at his residence in Estherville. While conducting the investigation, officers were able to locate a large quantity of the items that had been reported stolen from the victims. Following the investigation, officers placed 21 year old Andrew Brackins of Waterford, Michigan under arrest. Brackins was placed in the Emmet County Jail and charged with 14 counts of Burglary in the 3rd Degree. A female suspect was also arrested and placed in jail. Amber Zortman, age 19, of Estherville was charged with 6 Counts of Burglary in the 3rd Degree.

Brackins and Zortman both remain in the Emmet County Jail with a bond of $16,250 cash or surety on each of them.
The Estherville Police Department would like to thank the witnesses, without their assistance, this case would have been much more difficult.
The police department would like to remind citizens to lock up all of their vehicles and valuables. This is the time of year that property crimes seem to increase and we would encourage everyone to protect themselves by simply locking things up. The police department would also like to remind the citizens to call the police department if they see anything suspicious or encounter someone breaking the law. Approaching and confronting suspects can be extremely dangerous, and law enforcement officials would prefer that if you see something to call first, get a good description of the suspects or vehicles, and get the last known direction of travel. ESTHERVILLE POLICE DEPARTMENT TO HOST CITIZENS ACADEMY
The Estherville Police Department will host another Citizens Academy April 21st 2011, through May 17th 2011. The class will meet Tuesday and Thursday evenings from 6:30 P.M. to 9:30 P.M. Students of the academy will be instructed on several aspects of law enforcement including: investigations, SWAT, operating while intoxicated, patrol operations, and firearms just to name a few.
The police department has been conducting citizens academies since 2000, instructing over 60 men and women of the community and students at Estherville Lincoln Central High School. The academies were started in 2000 by now Retired Officer Terry Watters and will be led by Officers Dunlavy and VanRoekel.
The requirements to attend the course will be, that the applicant be 16 years of age or older, no felony or domestic violence charges or convictions pending and have a good standing with law enforcement. It will be open to all people who live and work in the Estherville area. There is no cost to attend the academy. Academy graduates will receive a Citizens Academy t-shirt.
There are two ways to obtain an application for the Citizens Academy:
Pick-up an application at the police department or fill-out the application online at http://www.esthervillepd.net/ . Applications must be returned or submitted no later than Thursday, April 14th 2011.
We would like to invite anyone interested in a career in law enforcement or anyone that just wants to learn more about the job our officers do, to attend this class.
